Guide Agreement

This Guide Agreement ("Agreement") is between Tek a Hike Limited ("Tek a Hike", "we") and the independent guide who registers to lead hikes booked through the platform ("you", "Guide").

1. Eligibility & licensing

You confirm you are legally able to provide guiding services in Jamaica, hold any licences or permits your activities require, and will keep them current. You will provide proof on request.

2. Safety & guide-to-hiker ratios

You will follow Tek a Hike's safety standards — including the guide-to-hiker ratios and hazard requirements published for each trail difficulty — and will not lead a hike that breaches them. You are responsible for the safety briefing, route conduct, and emergency response on every hike you lead.

3. Insurance & indemnity

You are responsible for your own public-liability and personal insurance unless otherwise agreed in writing. You indemnify Tek a Hike against claims arising from your negligence, breach of this Agreement, or failure to hold required cover.

4. Conduct

You will treat hikers, host communities, and fellow operators with respect, act professionally, and not discriminate. Tek a Hike may suspend or remove you for conduct that endangers hikers or damages the platform's reputation.

5. Environmental & Cultural Heritage Pledge

You agree to uphold and enforce the Tek a Hike Environmental & Cultural Heritage Pledge — tek pictures, mek memories, leave only footprints — on every hike, including its no-litter, no-picking, and heritage-protection rules.

6. Data protection (JDPA)

Tek a Hike is the Data Controller for participant data on the platform. You receive only the limited participant information needed to deliver a booked hike, act as a limited processor/recipient, use it solely for that purpose, and delete it when no longer needed. You will not share it with third parties.

7. Payments & fees

Tek a Hike collects booking payments and remits your share, less the agreed platform fee and any gateway charges, on the published payout schedule. You are responsible for your own taxes.

8. Suspension & termination

Either party may end this Agreement on reasonable notice. Tek a Hike may suspend your listing immediately for safety, legal, or conduct concerns. The indemnity, data-protection, and payment sections survive termination.

9. Changes

We may update this Agreement; material changes require re-acceptance before you continue guiding through the platform.
